The Prison Rape Elimination Act 2003 (PREA) was enacted by Congress to address the problem of sexual abuse and sexual harassment within confinement settings. In 2012, the United States Department of Justice published a final rule adopting national standards for prevention, detection, and responding to prison rape under PREA. Consistent with PREA, the Alabama Department of Corrections (ADOC) maintains a policy of zero tolerance toward all forms of sexual abuse and sexual harassment. ADOC Administrative Regulation 454 – Inmate Sexual Abuse and Harassment (Prison Rape Elimination Act [PREA]) – outlines departmental policies and procedures that address prohibiting, preventing, detecting, and responding to allegations of sexual abuse and custodial sexual misconduct involving inmates in ADOC custody.
